SOCIAL HOUSING FUND

Unicaja has adhered to the agreement established on the 17th January 2013, by the Ministries of Competitiveness and Economy, Health and Social Services, Development, Bank of Spain, the Spanish Federation of Municipalities and Provinces, Third Sector Platform, the Banking Employers Association and 33 credit institutions, with the objective to create a Social Housing Fund (FSV) intended for the rent to families in special vulnerability situations.

 

This initiative comes on top of the efforts that, especially from the beginning of the crisis, Unicaja has engaged itself in favour of the most underprivileged collectives, such as refinancing, grace periods, voluntary dation in payment or house purchase for its later social rent to the debtor.

 

Unicaja contributes 375 homes from its assets to the Social Fund. The current agreement, renewed on 14 September 2015, has been extended for the tenth year running, through to January 2026.

 

As a consequence of the amendment of the first additional provision of the Spanish Law 1/2013, of 14th may, on measures to reinforce the protection of the mortgage debtors, debt restructuring and social housing rent (Ley 1/2013, de 14 de mayo, de medidas para reforzar la protección a los deudores hipotecarios), five per cent of the houses are assigned to people who have been evicted from their houses due to the default of non-mortgage loans.

 

Based on these changes, families or people who have lost their main residence and who fulfill the following conditions will be able to benefit from this measure:

  1. They must have lost their main residence after the 31st December 2007 to any of the credit entities signing the Agreement due to one of the following reasons:

    1. Eviction due to a claim for performance, default of a mortgage loan or default of a non-mortgage loan.
    2. Foreclosure proceedings which have finished with the allocation of the house, but which have not led to the actual eviction.
    3. Dation in payment of a mortgage loan.
      This provision will not be applicable to the dation in payment envisaged in the Code of Good Practice for the feasible restructuring of debts with mortgage securities on the main house, when the debtor has requested or requests to stay in the house, as tenant, during the two years established in the Code, unless the rent paid is higher than the rent that would be appropriate if this Agreement is applied.
  2. That when filling this application, they find themselves in the following circumstances:
    1. That the total income of the applicant and, where appropriate, of the members of the household unit, does not exceed the limit of three times the Spanish Public Income Indicator of Multiple Effects ( (1,800 euros according to the current IPREM).
    2. That the applicant or, where appropriate, any of the members of their household unit owns a house or has one in usufruct.
  3. That the applicant finds themselves in a scenario of special vulnerability. To that end, any of the following will be accepted as such:
    1. Household unit with children under age.
    2. Single-parent household unit with two or more dependent children.
    3. Household unit where any of their members has over 33% disability legally declared, are in a situation of dependence or illness that permanently incapacitates them to engage in a work activity.
    4. Household unit where the mortgage debtor who has lost their house is in a situation of unemployment and has exhausted the employment benefits.
    5. Household unit where one or more people live, who are linked to the owner of the mortgage, the default of which caused the loss of the house or their spouse through the family relationship by virtue of either consanguinity or affinity up to a third degree, and where any of their members are in the personal situation of disability, dependency, severe illness that incapacitates them temporarily or permanently to engage in a work activity.
    6. Household unit where there is a victim of domestic violence.
    7. People in a situation of dependency or with a handicap to whom the house is, according to the report of the appropriate social services to verify such situations, an essential asset for the maintenance of their social inclusion and autonomy.
    8. People over 60 years old.
    9. People in a situation of pre-retirement or retirement who, by means of a bank guarantee, have taken over their children&aposs or grandchildren&aposs debts.
    10. Other people or household units under social vulnerability circumstances different from the aforementioned that might be detected by the credit entities, municipal social services or non-governmental organizations within the Third Sector Platform, and duly justified before the credit entities, for which the house means, in accordance with the report of the appropriate social services to verify such situations, an essential asset for the maintenance of their social inclusion.

Household unit is understood to be made up by the applicant, their spouse not legally separated or registered unmarried partnership and the children in case they exist, independently of their age, that live in the house, including these related by tutelage, legal guardians or fostering.

 

Regarding the election of the beneficiaries, the Agreement specifies in clause 3ª the eligibility requirements of the Housing Social Fund. Based on these eligibility requirements, the Agreement states in clause 5ª that its member entities will have to make a prioritization of the aforementioned criteria.

Unicaja will take into account for this prioritization the objective conditions that aggravate the vulnerability situations. In this sense, the following are considered prioritization criteria:

  • Concurrence of circumstances. The more circumstances concur, the higher the priority
  • Nº of members of the household unit. The highter the Nº of members, the higher the priority
  • Net income of the household unit The lower the income, the higher the priority

Based on these criteria, a prioritization of the applications will be made.

Other criteria such as disability degree, dependency or other conditions detailed in the reports presented by the social services will be additionally considered in the process of the prioritization of applications.

 

In order to qualify for a house included in the FSV the person benefiting will have to present in any of the Branches of Unicaja or in Asset Management of the Regional Departments, at the time of the application, the following documentation:
